As a fitness and coaching business, we collect sensitive health information including:

• Current health status, medical history, injuries, and physical conditions
• Fitness levels, exercise history, and body measurements
• Nutritional habits, dietary requirements, and food intolerances

We only collect this information with your explicit consent and only to the extent necessary to deliver your program safely and effectively.

If you choose not to provide certain personal or health information, we may be unable to safely or effectively deliver your coaching program. We will advise you of this at the time of collection where relevant.

6. Disclosure to Third Parties

6.1 Technology Platforms

• Trainerize (ABC Trainerize Inc., Canada) — workout delivery, progress tracking, client check-ins
• GoHighLevel / GHL (GoHighLevel LLC, USA) — CRM, email marketing, booking, and communications
• Stripe Inc. (USA) — secure payment processing
• Anthropic / Claude AI (Anthropic PBC, USA) — AI-assisted program development and business administration
• OpenAI / ChatGPT (OpenAI LLC, USA) — AI-assisted content creation and business administration

6.2 Use of AI Tools

We use Claude AI (Anthropic PBC, USA) as part of our coaching process. This includes reviewing your health information, progress data, check-in responses, and program notes to assist in creating and personalising your program. This is an active and intentional part of how we deliver our service, not an incidental use.

We also use ChatGPT (OpenAI LLC, USA) to assist with program development, content creation, and business administration.

Both Anthropic and OpenAI are based in the United States. Your data may be processed on US-based servers. Anthropic's terms include commitments that customer data is not used to train AI models. You will be asked to provide explicit consent to this use of your data in your intake form before your program begins.

If you do not consent to your health and progress data being processed by Claude AI, please contact us before enrolling. We will discuss alternative arrangements where possible, noting this may affect the level of personalisation we can provide.

6.3 Overseas Disclosure

Several third-party providers store and process data outside Australia, primarily in the USA and Canada. By using our services, you consent to your personal information being disclosed to these overseas recipients.

6.4 Other Disclosures

We may disclose your information where required by law, court order, or government authority, or where necessary to prevent a serious threat to health or safety. We do not sell your personal information to third parties.

7. Data Quality

We take reasonable steps to ensure the personal information we hold is accurate, up to date, complete, and relevant. You can help us by notifying us of any changes to your information during your program.

8. Storage, Security and Retention

We store your information using secure cloud-based systems. We take reasonable steps to protect your information from misuse, interference, loss, or unauthorised access. We retain client personal and health information for 5 years after the end of your coaching relationship. Financial records are retained for 5 years in line with ATO requirements. After the applicable retention period, information is securely deleted or de-identified.

9. Notifiable Data Breaches

We are subject to the Notifiable Data Breaches (NDB) scheme under the Privacy Act. If we experience a data breach likely to result in serious harm, we will notify you and the OAIC as required by law.

10. Your Rights

Access: You have the right to request access to the personal information we hold about you. Contact us at [email protected]. We will respond within 30 days.

Correction: If you believe information we hold is inaccurate or out of date, you may request a correction at any time.

Deletion: You may request deletion of your personal information, subject to our legal obligations to retain certain records.
